I know that there are many that donate to charities in Thailand and that many on this board and others have charities. I have decided to organize a charity in the LOS. What steps do I need to go through to make this a legal, professional charity. I have already decided it will have a US based component that money will be tax deductible for US citizens. I want this to flow directly into the charity in Thailand with every dollar accounted for and everything totally visible for all to see.

 

Are the local charities independent or under the umbrella of another Thai Charity?

 

GayButton gave me good advice to also contact the Embassy and ask their advice and I'll do that as well. As far as getting this set up and legal, does anyone have any suggestions, comments or advice? It would be most appreciated!

I think your first step should be to speak to a good Thai lawyer who knows the local laws regarding charities and charitable donations made in Thailand and also those sent from abroad.

I have heard that, strictly speaking, formal charitable donations made in Thailand to a Thai charity are subject to a 10% tax. Also I have heard that Thai charities need a majority of Thais to be their directors. I say "I have heard" and that is all - I don't know for sure if these 'hearings' are true or just bar gossip. So ... go see a good lawyer.

I think, in addition to the embassy and Thai attorneys, it would also be a good idea to seek out and meet with directors of charities already established in Thailand and find out whatever you can from them, especially any charities that are similar in nature to the type of charity you intend to establish.
