Mostly because everything the author argues seems possible. And it boils down to the idea that Clarence Thomas and his fellow asshole right wingers on SCOTUS perhaps could give a flying fuck what Gay people think. If they did it with abortion, of course they could do it with same sex marriage. Every time I think that America under Trump can't really be THAT bad, it turns out that it really is that bad. First, When Iowa's court ruled FOR marriage equality, the decision was so well written that legal experts predicted it would be difficult for Iowa to ever undo the decision, and that the decision would help serve as guidance for other cases, even outside the US. So one might hope, for Kim Davis, the legal defense will study that Iowa case for any helpful pieces. Iowa legalized same-sex marriage in 2009 following their Court's unanimous 7-0 decision in Varnum v. Brien, which found that the state's ban on same-sex marriage violated the Iowa Constitution's equal protection and due process clauses. If you search, you can find links to the decision and all sorts of other references to it. Back then, I read the entire decision. One thing I recall, when the lawyers raised the historical argument against, that gay marriage goes against long held religious beliefs, the Court spoke on that saying specifically that under Iowa's Constitution, the religious argument was not applicable. They also said that marriage equality does nothing to harm any of the government's functions in Iowa. It's a good read, if you can find it. Second, Kim Davis has been married 4 times and committed adultery. Perhaps some clever legal minds can weave that situation into their arguments why she is not a compelling plaintiff and that her case is not extremely worthy. One would hope her religious beliefs are out of scope for performing her job of county clerk. Yet with the current SCOTUS, I fear she might get an unreasonable amount of sympathy. Hope not.
