Sad situation for both men.  Basically comes down to he said/he said situation and which story you believe.  Correct me if I am wrong, but HIV testing can only detect if you have HIV.  It isn't able to tell how long you have had it or what stage you are in.  Not sure how they would prove who was infected first.

A simple rapid test, yes. But there is also a more advance test that can shows the viral loads, and high correlation between high viral load and chances of infecting others.
