Refund Or Non-Refundable??

DISCLAIMER: This may be a challenging post, so well prepared on whatever is thrown at me for this.....

About three weeks ago a client of mine in Charlotte, NC inquired about doing an overnight session in ATL within next month or so, and I told him in order to hold a guaranteed spot I would need a deposit of some kind for which he agreed, and paid about 25% of the fee upfront in my bank account in order for me to hold the appointment for him on that actual date and time he booked me for. In the process, he made me form a contract by via-email to show in writing that he paid me a deposit to book the appointment, and will pay the remaining upon arrival at my residence in ATL.

Meanwhile, a week later during my stay in his hometown in Charlotte, NC, he booked a 90 minutes session for 530am Saturday morning (may I state this was during the same weekend Hurricane Matthew was going on). I had two other clients who wanted to see me at 6am and 8am, but couldn't see them on the count on this client booking me first for 530am.

530am comes, and the client (who's a regular) was a no-call - no show. I received a text from the client at exactly 532am to state his alarm clock didn't go off due to the storm, and would have to push the appointment til the next day (Sunday) being he had family obligations with his wife and kids to tend to at 8am, and lives 45 minutes away from Charlotte, NC. I was infuriated because how irresponsible the client was being he should have set his alarm on his cell phone and not at his home knowing how we could possibly receive some effects from the storm to where the power could possibly been affected.

Informed the client this was not good business practice on his part being he contacted me at the VERY last minute, and due to this unfortunate mishap I missed out on other possibilities I could have had if he informed me in time. He said he was sorry, but it couldn't be helped being he overslept which is fine, but was hoping maybe he would in someway would have re-scheduled for that same day or compensated me for the missed time knowing I missed out on other jobs. He should have did what I did knowing the storm was in effect by setting the alarm on his cell and not through his landline knowing the power could be affected due to Hurricane Matthew.

I set my alarm on both my personal cell and my business so I wouldn't oversleep as I didn't relay on the hotels electricity/alarm. He apologized left and right, and took blame for his irresponsibility, but still called himself punishing me later as you will read by dismissing me based on his mistake.

The client went off profusely with obscenities, and was very aggressive/arrogant over the fact I wasn't happy about the situation of missing work, and threw in my face on how he just paid me the week prior of $550 bucks as a deposit for an upcoming overnighter and that he will come through on Sunday to make up for the missed appointment on Saturday. I tried to explain to him that is well and fine and appreciate his business, but the fact remains here I still missed out on opportunities that could have been fulfilled if he informed me in enough notice that he wasn't going to be able to make the scheduled appointment, and not have informed me on the very hour and time he was due to arrive.

Later that day he Paypal me the $300.00 fee for the missed appointment as he became extremely hostile and arrogant in his email by dismissing me as a regular escort and voided out the overnight appointment by asking me to refund him the deposit because he doesn't care to ever meet or talk to me again.

I reminded him of our agreement/contract and think he was flying off the handle over something I had every right to be upset about knowing I missed work on the count of his irresponsibility in not giving enough notice.

Earlier this week he emailed me again to say he wants his money back, and I told him I'm not repaying anything to him until he calls, and sort this mess out. He then makes a racial comment stating this....."What's comical to me is, now that I think back, you are a perfect example of where and why this country is where it is today. People of your ethnicity have truly learned to use abuse and milk the system dry. As I stated in my previous comment above, the lack of education and the feeling like this world owes them it all".

From this cunty rant of his I became VERY irate, and told the client to never contact me EVER again as this was uncalled for being he no respect for me nor my time or practices as a professional escort by taking my time to his advantage and for granted like he has. His response was.."Your wish is granted, NIGGER!"

"Call me racist or whatever you want, I’m stating the facts. If you think that’s racist, then prove me wrong and don’t be a follower of your fellow brothers in regards to what’s put them in the class that’s defined your ethnicity as needy."

"I will just have to send some of my Klan boys to pay you a visit then!"

To further insult me racially and to prove his point, he has the fucked up nerve to send this to me in an email....

This is why I don't knock anything that Mocha from the other forum state that is of truth about racism in the escort world because as a black man I have too have encountered more racism in the escorting community then I ever has in any other profession, and have seen this behavior in both escorts and clients.
 
First it was the BS with Killian James making racial comments and slurs at me, and now being racially harassed and abused by a regular. I agree with Mocha to an extent that some clients do mistreat or railroad black escorts as look what this client did to me over something that totally innocent on my part, but took advance cause I'm a black escort he could do and treat me however way he wanted for which I did not tolerate under any circumstances, and in the end he shows his true colors by calling me racial slurs and lewd comments that degrades black people. Not everything Mocha says on "the other site" about such topics are exaggerated seeing what's happened to me as a black escort when it comes to this sort of stuff of being racially profiled and insulted for no reason or reasons that are innocent that are unfortunate.
 
I told him due to actions like this is what gives people like him a bad name (which is true). Just because I wouldn't tolerate him disrespecting my time or how I conduct business (professionally) brought him to such extents on being a full on bully by intimidating me, and insult me like racially.
 
He is better off from now on staying far the hell away from me .
 
He still emails from time-to-time stating he wants his precious $550.00. I don't know guys - do you think I should just Paypal him the money back or just go by what the contract says and keep it? I think maybe I should give the money back, and sever all ties being he's crossed the line by calling me racial slurs and such in order to get what he wants.

That black and white gif is an episode from the twilight zone, which is why I "liked it" That was kinda scary episode lol.

Anyhow, as far as the main topic...JD this is unfortunate. However, my hat goes off to you because I wouldn't ever be able to take 2 appointments prior to 9 am, and 5:30 am...well, that's about 2 hours after my bedtime on a late, late night. That's a bit too much scheduling so early in the morning. I would be the one to oversleep, until NOON lol. But I'm just not a functional working morning person, unless I'm working in bed ;)

I think in this situation, the times with the other clients were set too closely. If regular 1 was already booked at 530, then the 6 and 8 am clients could have been moved further out. That way, just in case regular 1 cancelled, you'd had some buffer time. 

It should have never came down to a racial standoff, but with clients....we just can't allow things to get to a point of no return. I can be a bit off the mic here, but in reality I know at any moment a client can go from 0 to 100 real quick and past relationships with friends, strangers and clients have taught me that anyone can resort to racial, sexual, financial, or physical put downs in a blink of an eye. One of my best friends used to occasionally call me the N word in a drunken argument. Then once or twice even sober. And then not remember it the next day. However, til this day we remain good friends and even having taken time apart, our bond grew stronger. 

BUT, the boundaries on my end have also gotten stronger. In your case, taking the money upfront and doing a contract kind of set too much leverage and commitment on both parties. It's like you both were obligated before the booking even took place. He felt he could cancel, you felt the money is owed. In a court of law, it's likely he wouldn't be entitled to a refund depending on the agreement...however with the situation it's likely he could file in small claims and a southern judge probably would be quite conservative.

I would find a way to give the money back in this scenario. This is def. not the type of situation anyone would want to have with a regular. But, I've learned sometimes with clients even when they cancel, you almost have to suck it up and then bring it up next time. Especially if they are a good regular. I mainly only blacklist new customers I've never seen before if they set me up after I've got a hotel out of town or something. 

I know it's business and I'd be pissed too, but though it's business, we also deal with married men...and in my personal life I'd never ever have any dealings with a married man because their family business will trump our business at any moment. Most married men could vanish without a trace of they cut off "the life". More of a when, not an if.
