If you have a password on your device and refuse to open it for the Customs agent, or have a lock on your bag and refuse to open it, I think you will find that the agent will seize the property and can have it sent to a lab to be opened.  Whether there are additional penalties for failure to cooperate with a Customs agent in a lawful search, I do not know.

So it means other than unlocking the phone, apps that stores hidden photos & videos are also required to be further unlock at the Customs request...

A lot of talk here about photos but how many here delete their browser history and especially cached files before they travel? Depending on the sites you visit, and the browser you run, you may not even realise you have photos of twinks, let alone know their ages. After all, it isn't unheard of for people to be on Grindr, hornet or other sites and lie about their age.

That is a valid point. As I said if you are that worried about it use the cloud and then restore on each side. The model photo thread certainly has some questionable photos albeit no full frontal nudity. 

 

The most pertinent question at this point would be why do these photos mean enough to you to risk actually being caught out because of them? Normally I can rationalize deleting my pics. Why would you even travel with them in the first place and then point out in plain day what you are traveling with? 

 

You can restore your device to factory settings and restore from an encrypted back up. Most of this talk is sheer madness at this point.

I already previously said I didn't know if they need a warrant or not. I was not practicing law as I said you would need a lawyer. I advised to error on the side of caution and stick by that. What it seems like is you can be searched with out a warrant and if the search justifies it they will get one. 

 

It was my contention that if you refuse a search they would get a warrant and I am not wrong. The only thing that isn't clear is if you can be compelled to give your password. Anyway I will leave smuggling child porn to our resident expert Firecat. He seems to be well versed.

Though in the digital age they can't serve a warrant by busting down a door. So it is a bit different. They can execute a warrantless search however they can not do so with out you giving them a password. They can not force you to do so. So the doctrine is meaningless unless you don't protect your data. 

 

If you have a laptop that is password protected and refuse the search the police must show a judge proof of cause to get a warrant. If you are an American citizen obviously. If you aren't you will be refused entry as a matter of course. If the Customs department ever challenged me I would call my lawyer. 

 

They don't have time for it. They would seize the computer and have to let me through with out charge and get a warrant in the mean time. They could temporarily detain me for questioning. 

 

This would not grant them any reason for arrest and they would be lucky to get a warrant out of it, if you have an attorney. I am not playing attorney here I hire one because I know better. 

 

If you have an attorney on call the 9th judicial court rejects these methods and they will not bother you. This is fascism anyway you look at it. Most people will bow down to it. If you are not a citizen you have no rights anyway. If you are the premise of the law is questionable. You can not ever be asked for your password with out a warrant. They can search but that is it. To get a password or admin to your computer relies on you voluntarily giving them that information.

 

They will need a warrant.

Why is no one troubled by how discriminated we are? I am pretty sure single women arriving from Thailand won't be searched.

 

While I read more often in American and UK news, stories about women (often teachers, neighboors) arrested for sex with underage American or UK boys, than I am reading this about men.

 

Gay go go bars also have women

 

Women can also be sex tourists. European women for example have Africa for this as popular destination. Read once about this.

 

Knowing all this then the fact that only single men - who return from a known sex destination - are being searched is pure and simple: discrimination.

 

If it was reversed the feminism movement would complain. It would be all over in the news how oppressed and discriminated women are. Why do we accept being discriminated against?

 

Next time tell the officer you are going to sue him.

given the already high level of conflicting information posted here I suppose we should not open the unlock by fingerprint v's unlock by password "testimonial communication" constitutional can of worms here when seeking to find a simple solution to how to protect our data!

I really don't see a big problem here.

 

My folder with favorite pictures has about 500 files in it, and its size is a mere 50 Mb.

It is placed in an encrypted file with a non descriptive name, that can only be opened (mounted) with truecrypt.

 

Next time I make a trip I will place it among the hundreds of temporary files created by the operating system.

Before leaving I will uninstall the truecrypt program.  Once at the destination I will reinstall it from the web.

On return, I will again uninstall truecrypt before the flight back, and reinstall it once at home.

 

If some authority wants to investigate an insignificant person like me,  which I doubt,  they will not look at all the tens of thousands of files on my laptop.  They won't have a reason to look for encrypted files, since I won't have a program to deal with them.

 

I think that the probability I get in trouble with my sex files will be as low as the probability that the plane I am in will fall from the sky and crash in the ocean.

I agree. But still, why do you have to take these precautions and women don't? Women returning alone from Thailand aren't checked.

When you go back to the USA from any trip abroad, you loose all your rights until you are on American soil. That soil is AFTER customs and immigration have cleared you.  You and anything you own may be searched and there is no warrant needed.  If you refuse, they may legally confiscate it. It is their right to do that and it is done often when people refuse passwords to computers.

 

When you travel into any other country, their country may do the same to you upon entry.
